Iīd be inclined to believe itīs the fender. My bikeīs sissybar was, for some reason, leaning slightly to the right side. Also the fender had a few mm offset to the right. The bike had not had any major accidents, it came that way.
Check the wheel alignment with a lenght of string. When the wheels are in a perfect alignment, and if the rear is still skewed, you could maybe modify the fender attachment bolt holes to make it sit straight?!
